Trustees vote to disallow variance request for trash enclosure at car dealership

On the agenda at the regular meeting of the Mayor and Board of Trustees on Jan. 20 was approval of Ordinance No. 901: an ordinance denying a variance from the trash enclosure requirements for Poage Cadillac Buick GMC, located at 1500 Koester Drive in Forsyth.

A vote to recommend denial of this variance request had already come down from the Planning and Zoning Commission dating to its meeting on Dec. 19. The original request from Poage was filed in October.
Trustees had two options: (1) draft an ordinance approving the variance (a two-thirds vote by trustees would be required to approve and override a recommendation by the Planning and Zoning Commission; or (2) draft an ordinance denying the variance request.

At the December Planning and Zoning meeting, a Poage representative, Steve Dawkins, appeared before the commission. Dawkins told commissioners that complying with the ordinance to enclose the trash dumpster at the dealership was a complex and complicated process that would need the approval of General Motors in Detroit.

Dawkins described a three-step process that begins with GM’s district manager, then goes on to a zone manager before landing in Detroit to be taken up by a department called Essential Brand Elements.

Several commissioners empathized with Dawkins and the bureaucratic complexities he faces in trying to comply with the ordinance, especially given that the dumpster is likely a holdover from the 1970s.

“I’m sure this isn’t the first time a GM dealership has had to deal with this problem,” Jim Peck said.

Just before the formal vote took place on Jan. 20, Trustee Bob Rasho asked that staff work with Poage in meeting all the requirements. Village Attorney Jeff Jurgens said that would be the likely next step.

Trustee Dave Wendt made the motion, which was seconded by Trustee Kerstin Trachtenberg. All votes were to deny the variance.
